Agreement
These terms are an agreement between you and Belvedere, built and run by LJ Kennedy in Spokane, Washington ("Belvedere," "we," "us"). By creating an account or using trybelvedere.com or app.trybelvedere.com, you agree to these terms and to our Privacy Policy.
Using Belvedere
Belvedere is a workspace for licensed real estate professionals and their teams. It helps you prepare CMAs and reports, keep a CRM, send client communications, view a calendar and run marketing. You must be at least 18 and able to enter a contract.
Belvedere is a tool. It is not a brokerage and does not give legal, tax, lending or appraisal advice. Price opinions, market statistics and estimates are for discussion and are not appraisals. You are responsible for checking the work you send to clients.
Accounts
Keep your sign-in private, and tell us right away if you think someone else has used your account. You are responsible for activity under your account. Team leaders who invite agents are responsible for giving them the right access.
Your data
You own the content and contact information you put into Belvedere. You give us permission to store and process it only to provide the service to you, as described in our Privacy Policy. You are responsible for having permission to keep and contact the people in your CRM and for following the rules that apply to you, including fair housing laws, the CAN-SPAM Act, the Telephone Consumer Protection Act, your MLS rules and your brokerage's policies.
MLS and listing data stay subject to the rules of the MLS that supplies them. Use them only as your MLS membership allows.
Google, Microsoft and other connected services
You can choose to connect outside services, such as Google Calendar or Microsoft Outlook calendar. When you connect one:
- You authorize Belvedere to access that service on your behalf, only for the permissions shown on the Google or Microsoft sign-in screen. For calendars, that access lets Belvedere read your events and add, change or delete events only to keep your Belvedere appointments in sync, or when you edit or delete an event from inside Belvedere.
- Belvedere uses the data only to show your events in your Belvedere calendar and to keep your Belvedere appointments and your connected calendars in sync, as described in our Privacy Policy. Belvedere's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
- You can disconnect at any time in Belvedere, from your Google Account, at account.live.com/consent/Manage for personal Microsoft accounts, or at myapps.microsoft.com for work or school accounts.
- Your use of Google and Microsoft is also governed by their own terms and privacy policies. If you use a work or school account, your organization's policies apply, and your administrator may need to approve Belvedere.
- Belvedere isn't affiliated with, endorsed by or sponsored by Google or Microsoft. Google, Google Calendar, Microsoft, Outlook and Teams are trademarks of their owners.
- Connected services can change or stop working because of the provider. We are not responsible for outages or changes on their side.
Ownership
Belvedere, including its software, design, screens, text, workflows, templates and documentation, is owned by John James Kennedy (LJ Kennedy) and protected by copyright, trade secret and other laws. All rights not expressly granted in these terms are reserved. See our Copyright Notice.
While your account is active and in good standing, you have a limited, non-exclusive, non-transferable right to use Belvedere for your own real estate business. You may not:
- copy, modify, translate or create derivative works of Belvedere;
- reverse engineer, decompile or try to extract its source code or underlying design, except where the law allows this despite this restriction;
- sell, rent, sublicense, frame or mirror Belvedere, or share your sign-in so others can use it;
- use automated tools to collect content or data from Belvedere, other than exports Belvedere provides; or
- use Belvedere, or screenshots, recordings or documentation of it, to design or build a competing product.
Your content and client data stay yours, as described under Your data. If you send us suggestions or feedback, we may use them freely without any obligation to you. "Belvedere" and its logo are trademarks of LJ Kennedy.
Billing
Paid plans are billed in advance through Stripe and renew automatically until cancelled. You can cancel at any time and keep access through the end of the paid period. Fees are not refunded except where the law requires. We will give you at least 30 days' notice before a price change takes effect.
Rules
Don't use Belvedere to:
- send spam or messages to people who asked you to stop;
- discriminate, harass, or break fair housing or other laws;
- upload anything you don't have the right to use;
- try to break, overload or get around the security of the service, or copy it in any way the Ownership section does not allow; or
- resell Belvedere without our written permission.
We may suspend accounts that break these rules or put others at risk. Where possible, we will warn you first.
Legal terms
Changes and availability
We improve Belvedere often and may add, change or remove features. We aim for the service to be available at all times but cannot promise it will be uninterrupted or error-free.
Ending your account
You can stop using Belvedere at any time. You can export your data before you close your account. After closing, we delete your data as described in the Privacy Policy.
Disclaimers
Belvedere is provided "as is." To the extent the law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
Limit of liability
To the extent the law allows, Belvedere is not liable for indirect, incidental, special or consequential damages, or lost profits, data or business. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
Indemnity
You agree to cover claims brought by others that arise from your content, your messages to contacts, or your breaking these terms or the law.
Governing law
These terms are governed by the laws of the State of Washington. Any dispute will be handled in the state or federal courts in Spokane County, Washington.
Changes to these terms
If we change these terms in an important way, we will update the date above and tell you in the app or by email. Continuing to use Belvedere after that means you accept the new terms.
